Do you believe that the ruling class unfairly passes laws that favorable to themselves and detrimental to the rest of us? If so what can we do about it?

Yes. Before the question is answered, one must broadly understand what law and justice entail. The definition of law is essential in understanding what demands. However, its explanation alone does not elaborate on its social construction. The most widely accepted definition of law is that law is a written body of rules and regulations that arises from the governing body and is enforced by its agents who prescribe punishments when the rules are broken. The definition conforms to Plato’s understanding of the law who believed that the law must be enforced by an all-powerful state (Law, 2015). Law has existed from ancient times; the only problem was that it was unwritten but even in this primitive societies people followed the rules. Law serves to administer justice in the community. The only question is whether the laws perform their duty.

A long time ago, societies were small. Consequently, the social connections were tight with a limited division of labor and with limited individual differences. The persons thought in the same manner and this bred a sense of collective consciousness, a concept known as mechanical solidarity. During the industrial revolution, the jobs evolved and it became clear that division of labor was the way to go. The social relations weakened or rather became temporary to achieve particular goals, a concept known as organic solidarity. It became apparent that some individuals controlled the resources available in society and thus began to rule over the poor (Swedberg, 2018). It is important to note that the ruling class has always been among the richest in society.

The ruling class always enacts rules that favor them. The most surprising aspect is that the oppressed perceive that the laws passed are legitimate, a concept known as false consciousness. The ruling class control resources to key institutions such as the media, education, church, and the law itself. Hence, the rich do not hesitate to direct the passing of legislation that favors them. For example, before the American Revolution, the colonists passed laws that dictated the possession of slaves (Peffer, 2014). The laws permitted them to oppress the slaves and granted them sovereignty over their lives with little to no protest from those in society. Such scenarios provide instances where scholars ask if the laws provided justice. The answer is no. Justice occurs when the meek, the weak, the poor, and the vulnerable are given access to the same privileges as the wealthy ruling class. The world is nowhere near achieving justice and persons around the world keep pushing for it. Previous laws limiting the administration of justice have been amended. For example, women are now allowed to vote, the rich now pay taxes that march their large profits, and slavery was banned.

However, for many people, justice exists in their imagination and has not been fully realized. The justice system is biased and designed to favor the richest and the ruling class. Take, for example, the media scrutiny that comes when a rich person is under investigation. Deep within, people believe that the laws may favor the rich hence the intense speculations that follow. The law permits all persons to hire an attorney which is right, yet the most powerful people get the best ones who can sway the judges for lesser penalties or none at all. This then begs the question if justice was administered for them because for the same crimes the weak get heavier punishments.

The social conflict theory by Marx and Engels views financial crime as a function of the conflict that exists in society (Tucker, 2017). The theory postulates that class conflicts produce crimes and, therefore, the rich and powerful create rules to protect their rights, privileges, and interests. For example, the embezzlement of funds by an employee is a violation of law which protects the interests of the employer. According to the social conflict theory, one may argue that if institutions create powerful impenetrable systems such laws would not exist. Consequently, financial laws are formed to protect the interests of the influential, rich people. According to the social conflict theory, law enforcement agencies are compelled by the predominant social class to protect their interests (Swedberg, 2018). The wealthy are allowed to take junks of money from their institutions to build executive homes as long as they do not tamper with the wealth of their shareholders. Top executives are awarded huge salaries that are several times the salaries of the lowest-earning employee. Surprisingly, there are no provisions to regulate bizarre practices, yet the rich rush to push for laws to protect their property.

Marx divided society into two classes the ruler and the ruled. The more someone has access to the unequal, inaccessible resources the more power such individuals possess. Marx postulated this as the ideal capitalist nation (Swedberg, 2017). The conflict theorists are convinced that social inequality is due to the differences in wealth, status, ideas, and religious beliefs. The laws enforced tend to target certain classes instead of individuals. There are ways to mitigate these social injustices. For example, the government should be given more power to oversee even the rich. The state should encourage and respect the rule of law. Another method is to enact laws that even the weakest in the society can relate to hence, create a sense of equity.

Video content is important because people are predisposed to share video content, and media video usage stands at more than 10 million daily minutes spent daily on viewing, which means it’s a platform with an unmatched audience. There are certain things to consider when creating a recruitment video. The video does not use boring corporate language and ensures that employees enjoy creating the video. Having fun ensure that the employees’ energy is captured with authenticity and show good vibes. Most importantly, the video shows the company culture. This report interprets a recruitment video from Zendesk in terms of underlying concepts, its organizational culture and structure.

Organizational culture

Organizational culture is the expectations adopted within an organization that guides the behavior of employees and is communicated through employee self-image, inner workings, and how they relate with the world. Organizational culture determines how employees identify with their organization and affect the way they interact among themselves, clients, and stakeholders. The culture of an organization is perceived through what people hear, see or feel about an organization and within it. Although people may come from varied backgrounds or hold high or low positions in an organization, they describe the culture of an organization in the same way.

Zendesk believes that it has created a culture where everyone belongs. At the end of the video, people who work at Zendesk are shown indicating the diversity in the company’s workforce (Zendesk). Their inclusion culture comes from their slogan of people first. The company strives to build a diverse team and considers diversity and inclusion as a cultural priority. Despite having such a large employment base, the company CEO gets to interact with the employees on a personal basis. The video shows team meetings led by the CEO who appears approachable based on how he chooses to approach the meeting, standing and very close to his employees. The employees also work quite closely, which indicates that they may have close relationships and identify each other. The part where the people working at the reception are introduced means the company recognizes all its employees as people and appreciates every member.

The involvement of every employee in this video might be an indication that employees are included at every level in matters of change. Working in group dynamics creates a culture that does not value individual performance. The mention of the team at every turn in the video may be a suggestion of the obstruction of individual roles from Zendesk’s mission. Involving every employee also shows that they perform their duties in line with the objectives of the organization. A recruiter will consider the diversity of the applicants knowing that the leadership team is emphasizing on diversity.

Seven dimensions of culture

There are seven dimensions that interact to capture the core of organizational culture. They include:

Innovation and risk-taking: today tech companies are encouraging their employees to be innovative and have the confidence to take risks

Attention to detail: this dimension requires employees to be focused on details, showcase precision and analysis.

Outcome orientation: this applies when managers pay attention to the results and not the techniques applied to achieve these results.

How Zendesk Uses Its Corporate Culture to Create a Competitive Advantage

Zendesk is a company that is able to put a hundred people in a single room and expect them to work together without any problems. For a company to reach such a point, it means the culture was developed from the beginning. In their recruitment video, one can see that the groups work in open spaces where many share the same space. Also, certain clips in the video show that Zendesk does not have a culture that is so corporate but rather one that is laidback.

With its twelve offices around the world, the company has been able to maintain an open culture that communicates widely and clearly. The company has also brought in different committees to take on group decisions. Zendesk’s culture has been able to retain its employees for many years because of its favorable culture. Since their talents have been associated with the company’s success, retaining these employees through a conducive culture creates a competitive advantage. The culture has also facilitated the recruitment of the best talent. As a software company, brilliant minds are a crucial asset in ensuring the competition does not surpass the business and take on its market.

Zendesk’s Organizational structure

Organizational structure directs how certain activities, including rules, roles, and responsibilities, are directed in order to achieve the objectives outlined by the organization. It also determines how information travels within the organization. Zendesk from the video appears to have a functional organizational structure where the company is subdivided into various departments on the basis of specialization. The employees of the company are shown in groups based on their departments. There is the marketing with their fish, sales and services team, engineering team, IT, support department, documentation department, finance and human resource. It is assumed that the executive team mention in the video is made of heads of these departments and may not possibly be a department.

Conclusion

Organizational culture is the beliefs that guide how certain things are carried out within an organization and how people within the organization conduct themselves. Zendesk has strived to create a culture of inclusivity that is not so technical and corporate looking. The company also operates under a team dynamic where group performance appears more important than individual performance. A good company culture translates to increased employee retention and an attractive work environment to capture more talent. The low turnover rate at Zendesk is a significant contributor to its superior competitive position. Zendesk’s functional organization structure subdivides the company into units based on specialization.

12 Years a Slave is narrative by Solomon Northup in 1855. The narrative describes the family of Northup who later get kidnapped and works in cotton plantation, in the Red River County, in Louisiana. Northup father was also enslaved and freed after moving to New York. Northup married a woman of mixed ancestry on Christmas Day and had three children (Solomon 47). Northup was sold into slavery by two men who offered him a travelling musical show. Northup severed many masters that he praised some and condemned others. Northup lived a devastating life in cotton plantation where he faced brutal and cruel masters (Follett 14). After many years of slavery, Northup received help from a Canadian abolitionist who assisted him in tracing his family. An official State report was released for freeing of Northup. Northup filed charges for the kidnappers but died before the end of the trial (Follett 23).

The movie “12 Years a Slave” is a historical drama that relates with novel “12 Years a Slave” by Solomon Northup. Steven McQueen is the director of the slavery film whose theme is from a true story (Fuller par 3). Northup had two children and wife. He maintained his family with earnings from violinist. The story-line talks on pre-civil war in United Stated where Solomon Northup was abducted and sold into slavery. Northup faced cruelty from the slave owner, Edwin Epps. Northup worked as a slave for twelve years then had a golden chance to meet with a Canadian abolitionist, Bass. On the other hand, the movie starts with slaves receiving instructions on how to cut sugar cane grass. Northup has flashbacks of his family during the happy moments and his career as a violinist. The flashback ends when the traitors leave Northup in the cell where he get accused as a runaway from Georgia (Fuller par 7).

The original elements in the novel are slavery, the main character Solomon Northup, Ford, and Edwin Epps (Solomon 84). The movie is a replica of the novel and shows many similarities. The narration of the movie gives a summary of the Northup lifestyle before starting his slavery life in snippets incidences as back-flash. The novel describes Northup life in slavery as encounters of many masters; some cruel while others requiring the praise. On the other hand, the movie describes two incidences of masters; Ford who requires praise and Epps who is renowned for his merciless beatings. The characters in the movie are reduced, but the main theme remains intact. Northup is sentimental on female slaves and is willing to help them. Similarly, the movie shows how Northup encourages Patsey in her slavery and ways to avoid sexual advances from Epps. Furthermore, in the movie, Northup convinces Patsey to remain in Shaw’s plantation where she is enjoying the treatment (Fuller par 8).

The themes of the original book have been emphasized in the movie through vivid description of punishments that take place in slavery. The movie also insists on the cruelty of masters in cotton and sugarcane plantations. Female slaves experience series of rape incidences from the masters. The masters go a step ahead and give authority of slaves to punish the fellow slaves. The movie director Steve McQueen shows the importance of family reunion through use of Solomon Northup. Northup is happy upon seeing his wife after twelve years of slavery. The wife and Northup are overwhelmed with joy. Family reunion is also a common theme in the original book since the narration ends with a reunion of Northup with his wife Anne, grandson and daughters (Solomon 93).

Introduction

The importance of insurance and especially medical insurance cannot be gainsaid as far as safeguarding the health of the nation is concerned. Indeed, it is recognized that health insurance lowers the cost that an individual would incur in case he or she suffers from an ailment or is admitted in hospital. However, recent trends pertaining to the uptake of insurance have been worrying. Research shows that there has been a consistent increase in the number of uninsured Americans with studies showing that 16 million, 29 million, and 30 million Americans had no insurance cover in 2003, 2010, and 2012 respectively (Fitzgerald, 2013). This has been mainly attributed to the relatively high cost of insurance, which makes it impossible for individuals to afford insurance policies. This underlines the fact that any strategy that aims at increasing the uptake of insurance in the United States would have to target the affordability of insurance policies.

Proposed solutions

According to Ferrara (2010) reforming Medicaid is the preliminary step towards the reduction of the number of uninsured Americans. This is especially considering the substandard coverage that Medicaid has been providing since its inception to the more than 50 million Americans. In this regard, the United States Congress must take proactive and comprehensive measures that would enhance the uptake of coverage. This would not only involve a reduction in the cost of insurance but also policies that would require individuals to take up medical insurance. The reforms will require the congress to transform Medicaid to assist Americans who cannot afford insurance cover in private health insurance. This will be accomplished by the use of health insurance vouchers and federal assistance block grants.

Indeed, different political parties have offered different proposal aimed at increasing the uptake of insurance by Americans. Republicans have vouched for market based solutions, where Americans would go for the cheaper health insurance policies that the market provides (Karen, 2007). This means that the companies would be competing on the basis of cost, which would essentially result in healthcare insurance cost reduction. Democrats, on the other hand, have proposed that public-based programs and employer-based coverage be expanded and strengthened through reinvestment of the gains derived from enhanced efficiency resulting from synchronization between results and incentives.

Obama medical reforms involve compulsive legal measures that would pressure uninsured Americans and insurance companies. They aim at decreasing the number of uninsured Americans through putting pressure on insurance companies and managed care plans to extend their coverage to individuals with preexisting conditions (Karen, 2007).

Obama care (Affordable Care Act) seems to have followed this strategy, especially considering that the federal government is bound to subsidize premiums so as to reduce the cost of health insurance, while still requiring all people to have health insurance. Such policies have been found as extremely effective in decreasing the number of uninsured Americans (Russell & Cohn, 2012). Studies on the effectiveness of customized Affordable Care Act in varied states show that it would decrease costs. Louisiana and New Mexico are projected to have a decline in their premiums by 2016 (Russell & Cohn, 2012). As much as some states such as Texas, South Carolina, Florida, Pennsylvania and Kansas are projected to have an increase in their premium by up to 43%, the increase is bound to be offset by federal tax credits.

On the same note, this strategy is projected to result in an increase in the number of insured Americans in the small group market. Scholars project that the small group coverage would increase by 5% in the entire United States, with research carried out on seven states including Ohio, New Mexico, South Carolina, Louisiana, South Carolina, Minnesota, Kansas, Texas and North Dakota showing a projected increase by about 7% (Russell & Cohn, 2012).

The movie conveys the account of a space traveler team who came down on an outlandish planet in the distant forthcoming. Undoubtedly, it is an important and effective media that plays an active role in continuing the survival and expansion of real art and culture in society. The social structures and economic factors play a significant role in a way that the first one is the main role of the demand for entertainment. In approximately all the situations we deliberate, the social demand for entertainment content is basically as a result of demand for amusement, with the economic impacts developing as a by-product. Kids watch films for the reason that it’s entertaining, and are more improbable to contemplate of the likely effects on their learning. The Orphanage is a Spanish supernatural horror film that was released in the year 2007. The director of the film is J. A. Bayona, who did his best to make the film cinematography outstanding (López, 2018). Boyana is a Spanish film director who was born on May 9, 1975. He has directed several films that include the 2012 drama film “The Impossible,” 2016 fantasy drama named “A Monster Calls” and the 2007 horror film, “The Orphanage.” Besides, he is the director of the recent film produced in 2018, a science fiction adventure film, “Jurassic World: Fallen Kingdom,” which is the fifth installment of the film series named “Jurassic Park.” He has also directed several music videos and television commercials, and this implies that he is a professional and competent director (Fife, 2008).

The main characters in the cast of the film “The Orphanage” include; Belen Rueda who is a Spanish actress who is best known for her role as Lucia in the television series Los Serrano and Julia in The Sea Inside. She won a Goya Award both in “The Sea Inside” and “The Orphanage.” In this film, “The Orphanage,” she plays as Laura the wife of Carlos as well as the adoptive mother of Simon. Another major character is Fernando Cayo. He is a Spanish actor best known for his role in Money Heist as Luis Tamayo. In this film, he plays the role of Carlos, and therefore he is the husband to Laura and also the adoptive father to Simon.  

Roger Princep plays the role of Simon in the film “The Orphanage” and is the young adopted son to Carlos and Laura. He meets imaginary friends in the Orphanage and threatens to run away with them. Mabel Rivera is a Spanish actor from Galicia. She plays as Pilar in the Orphanage. She is the head police psychologist who comes to investigate the truth about Benigna. Montserrat Carulla is a Catalan actress. In the film, she plays the role of Benigna Escobedo, who is a former worker at the Orphanage and who identifies herself as a social worker.

Another character is Geraldine Chaplin. She is an English-American actress and the daughter of Charlie Chaplin. She began her career in dance and modeling and later turned her attention to acting to follow her father’s footsteps as an actor. In the Orphanage, she plays as Aurora, and she is the medium sought to help find Simon when the police unable to trace him. Andres Gertrudix plays as Enrique in the Orphanage, and he is the sound technician of Aurora.

Edgar Vivar is a Mexican actor and is remembered as Senor Barriga and his son Nono from El Chavo del Ocho. He is also known as El Botija from Los Caquitos and Chespirito. He has also played a role in the Mexican telenovela, “Amarte Asi” as Pedro. In the film “The Orphanage,” he plays the role of Professor Leo Balaban, and he is the man who connects Laura with Aurora and also directs the spirit session in her house. Finally, Oscar Casas plays the role of Tomas in the film. He is the deformed son of Benigma, who is claimed to have been befriended by Simon.

The film has other support staff who plays the role of creative staff and include the producers such as Mar Targarona, Joaquin Padro, and Alvaro Agustin. Sergio G. Sanchez directs the screenplay (Aymerich, 2008). The music is produced by Fernando Velazquez, while the director of cinematography is Oscar Faura. Finally, the film is edited by Elena Ruiz.

Regarding awards, “The Orphanage” was chosen as Spain’s nominee for the 2007 Academy Award for Best Foreign Film by the Spanish Academy of Films. However, the film did not end up as one of the five final nominees in the listed category. Also in Spain, “The Orphanage” was nominated for the 14th Goya Awards, which included Best Picture and ended up winning the award for the Best Art Direction, Best Makeup and Hair, Best Special Effects, Best Director of Production, Best Screenplay- Original, Best New Director and Best Sound Mixing (Sánchez, 2007). In Iran, “The Orphanage” won the Crystal Simorgh for the Best Director at the “Seeking the Truth” section of the 27th Fajr International Film Festival.   

“The Orphanage” was positively received after release, receiving a ten-minute ovation from the audience (Boehm, 2012). The film received an overall rating of 87% from Rotten Tomatoes, and this was based on 176 reviews, with an average of 7.4/10. According to critics, the film was praised for its lack of cheap scares, with Bill Goodykoontz noting, “Bayona never lets The Orphanage descend into cheap horror. The scares here are expertly done and, placed in the context of Laura’s state of mind, well-earned, perhaps even explainable (or not).” However, the film also received a negative criticism by Lacey claiming that at, “[the film’s] core, it seems intended as a sympathetic drama of a bereaved mother, who may have slipped into madness. What’s even more disquieting is the persistent undercurrent of exploitation – the mixture of grief and jarring shock effects and the pitiless use of a disfigured child as a source of horror.”

The film was initially released in Spain, where it was immensely successful. After the fourth day of release, “The Orphanage” had raised more than 8.3 million dollars from 350 screens, and this made it the second-highest-grossing debut ever for a Spanish film. In December 2007, “The Orphanage” was opened in limited release in the United States, and by January 11, 2008, the film had a wide release. In Mexico, the film “The Orphanage” was opened on January 25, 2008, and through the box office, it earned a total of 11 million dollars, making it one of the best-selling films (Ryan, 2010). The film spent a total budget of around 4 million dollars and made a huge return since it made more than 78.6 million dollars through the box office sales.

The film is named “The Orphanage” since it is a place where children without parents are taken care of and housed. Simon is an orphan and has been adopted by Laura and Carlos. Based on this, the title of the film is well-matched with the subject of the film. Therefore, Boyana, as the director, has tried his best to make the film a success in regard to the subject of orphaned children. Based on this, it was worth relating the film with the subject matter. One of the questions that the film might ask is whether children should be allowed for adoption or should be left for the Orphanage to take care of them. The question to this is that children should be left to the orphanages since most of the adoptive parents become abusive to their adopted children since they are not the biological parents. Besides, adopted children receive less love and affection from the adoptive parents.

While some artists feel that piracy creates opportunities for exposure for them and access to their work for listeners, I have different thoughts. On my part, I feel that the harms done by piracy outweigh the benefits people claim to reap from piracy. Piracy is ultimately devastating to artists’ business because it causes big financial losses to actors, singers, directors, and other individuals who end up missing out on genuine sales and royalties that accrue from legal consumption of artists’ works. Also, piracy harms the artists’ welfare and pension while eating into the financial benefits of many workers who work behind the scenes in these art industries. Furthermore, the harms done by piracy outweigh the merits in that noticeable revenue declines are observable in these industries, a fact confirmed by Wlömert and Papies (2016). An example here is when some stole and leaked the Expendables 3 movie to pirates some weeks before it was released, causing about 70 million illegal views that culminated in a loss of about 20% of its potential revenue (Lang, 2016).

We should not forget that piracy has national budgetary implications seeing that the United States music industry uses billions of dollars in implementing anti-piracy measures, and in the long run, loses about 5 billion dollars per year of revenues to piracy, hence exacerbating the harms caused by piracy (Mahajan & Tripathi, 2020). In short, piracy can ruin an artist’s life by tipping them over the fiscal edge into financial bankruptcy, and those adapting and embracing the new industry of piracy should know that they are not immune to extreme episodes of piracy, hence might lose it altogether. For this cause, I advocate for the continued and enhanced fight against piracy as it is doing more harm than good.
