CISG Article Cover in Pratt and Whitney Case

The Convention aims to donate to the removal of legal barriers in global business and support the growth of international trade. The CISG denotes a multifaceted international agreement. Its main purpose is to support and promote intercontinental trade and lessen transnational trade disagreements by making the same law that oversees contracts for the international sale of goods (Felemegas, 3). It is the reason why the CICG covered Pratt and Whitney case. The complainant Pratt &Whitney saleable engine trade has had negotiated the perpetrator known as Malev Hungarian airlines to acquire jet engines. On 14th December 1990, the accuser sent two acquisition proposals to the perpetrator, one for Boeing aircraft and another one for the other engines. An overall of 4000 locomotives with four likely series with a time limit of 21th of September 1990. The perpetrator accepted the proposal. On 25th March 1990, the perpetrator told the complainant that they won’t buy the locomotives after communications and discussions. The plaintiff took legal action on the defendant, affirming that the defendant accepted the buying offer. CISG covered Pratt and Whitney case because it governs contracts for the sale of goods that are between buyers and sellers whose pertinent places of business are in different nations that have acquired the CISG as part of their law, referred to as “Contracting States.”

The results could have been different if Hungary had not signed CISG. The ruling and the case would have been handled in a different manner. CISG only functions in states that have signed its agreement. Suppose you hire a Mexican general contractor to build a factory in Mexican, and both U.S. and Mexico have signed the CISG article. In that case, CISG does not cover the contract since it covers only individuals that are in different countries that have signed the agreement. In this instance, both the contractor and the owner are in Mexico, and the factory is being built in Mexico.

Having been to this college for quite some time now gives me a chance to report and to know about different things that happen. However, some of those events have already caught me and most of the time it gets difficult for every person to develop what they need to do so that their life gets on the right course. Being at school makes us similar in some instances and different in other instances. For example, a person may say another is racist, ugly, and so much more characterization if we do not undoubtedly know a person. However, I have been faced with this problem. Even though it is a very important part of my life to keep my family life private in this paper I discuss and bring out one of the stories of my life which makes me think very much and become very emotional (Barrington, et al).

I rarely care about people’s notions and what they think about me. However, a year ago I noticed that several individuals were discussing me and how I had all over a sudden become dull and stopped talking to people. Many activities had happened in my life and I know that some things cannot be controlled, however, strength lies in hope. I have had the opportunity to live in one of the most peaceful and lovely families. However, this was not until my mum was very sick. For the whole of last year, I spent most of my time saving my mind and everything else that I could so that all my energy was focused on my mum. Therefore it was a difficult moment for me trying to push myself to stand in for people while at the same time trying to be good at home and support my mum who was very sick.

My mum is asthmatic and therefore she has her low periods and better periods. However last year especially with the presence of the coronavirus pandemic it was very difficult for her to get medicine. Therefore I tried my level best to make sure that she was good. Her fear to expose herself to corona made my family the losers as there was a lot of emotional pain and everything that was not okay. My father is a tough man but he is always good to his family and therefore I could do anything for him as long as I live. Even with her asthmatic attack last year she still fought her way and that everything that matters because her presence is very important to my life.

Therefore the sickness of my mum gave me a lot of perspective about life and how precious it is. This, therefore, made me think of how it could be if people stopped judging and live happier lives. Therefore lately the sickness of my mum was the only thing that frightened me the most and therefore I keep moving even though it is difficult at times to understand them a lot of pain which we human beings are always exposed to. This, therefore, means that my life even though having experienced the most emotionally devastating event in my life was good and I enjoyed it as I supported mum during her difficult period.

In conclusion, students, friends and sometimes even the closest person in my life could die any day and therefore it is always a good thing to live a normal life. This is because life is precious and it is always important to take care of those we love as I did with my mother.

“My Mother Woke a Rooster,’’ a poem by Laurie Ann Guerrero explains how the mother was amazed by her extensive presence in the kitchen which was tiny as well as the extraordinary strength in her thighs with the ease of the strut. The pan was hanging on the stove where she caught the reflection of herself and swooped her rubbery cockscomb back, letting it fall over her brow. She pursed her lips which were red in color and her mouth which was just visible deep inside a sharp beak. She watched in wonder the staccatoed swivel of her neck rubbing what the previous night is revealing the wrinkled throat of an old woman. Her eyes were now looking at the face of a fighting cock. Her tip of the toes which were red can now claw and was rough as rope.

The speaker of the poem “My Mother Woke a Rooster” uses a rooster and not a chicken or hen in that it is used as a symbol because it is vibrant and diverse as the mother in the poem. Rooster signs gist is all about fanning out with brilliance and showing the shimmering facets of personality. A rooster is used as a solar symbol and sign of illumination. Additionally, a rooster is considered as a timekeeper and a sign of time passing in speaker’s life. A rooster is used to reveal symbols such as strength which the speaker gives to the mother used in the poem. In the first line of the first stanza, the speaker reveals that the mother woke up early in the morning which discloses the timekeeping as a rooster is used symbolically. Moreover, a rooster is used as a symbol of strength. In the in the poem, the last line of the second stanza make known the strength the mother had in her thighs as the speaker postulates (Braden, 2008). Furthermore, a rooster is used as a symbol of boldness. In the first line of the first stanza, the speaker reveals that the mother was not surprised that morning by the stove when she cracked open a fresh brick of coffee with hands feathered as the bed from which she rose; revealing that she was bold enough.

In the poem, the speaker uses metaphor to refer to another thing to show or suggest that they are similar. In the first line of the first stanza of the poem, the speaker uses a rooster in place of the mother revealing how she woke up early and the actions that followed that morning. Boldness is portrayed in the poem in the first line of the first stanza where the mother is exposed not to be surprised that morning by the stove where she cracked opened a fresh brick of coffee with hands feathered as the bed from which she rose. Also, the writer portrays strength in the poem in the in the second stanza where the mother was amazed by her large presence of in the kitchen, the incredible strength in her thighs with the ease of strut. In addition to the rooster which has male characteristics, it still vigilance especially during the morning hours in that it must crow at a specific time. Vigilance is as well portrayed by the mother in that she wakes up in the morning. This is clear from the first line of the first stanza where the mother was not surprised that morning revealing that she woke up in the morning.

In the poem ‘’My Mother Woke a Rooster’’, the thesis can be tied to the metaphor in that the metaphor is used as a symbol to reveal the character traits the mother had such as strength which forms the thesis of the poem. With the rooster’s traits, a thesis of the poem can be analyzed supported by the traits which help the reader to understand the poem in a better way.

In the poem, the writer uses intense colors such as blue and black as well as a rose. Color symbolism in poetry imparts a deeper meaning to the words which in turn helps the reader to transform the written content into a more powerful instrument. Black color as used in the poem is used to symbolize power, formality, and elegance. From the poem in the second line of the second stanza, a bouquet of blue and black is revealed to rise hence given the power. On the other hand, the blue color is mainly used to symbolize a positive emotional response and is typically associated with the feeling of calmness, happiness, peace, relaxation, and comfort. The writer of this poem uses it to depict trust, loyalty, faith, confidence, and truth. In the poem, the writer walked to the sink of water and a bouquet of blue and black and rose from the coccyx. Therefore, this statement discloses that the mother was calm and happy as it moved like a waterfall swiping the sugar and cream from the counter. A rose, on the other hand, is used to symbolize love, beauty and something of value (Guerrero, 2013). The writer reveals the beauty of the bouquet by using the word rose in the second line of the second stanza.

Also, the writer uses rose as a flower to create a sense of beauty as well as rose a verb to create alliteration in the poem. This makes the poem more memorable and helps the reader to grasp the words.in the second line of the second stanza in the poem, the writer creates alliteration by using the word rose as a flower as well as rose as a verb. Also, the writer uses strange words such as coccyx and staccato to enable the reader to think critically hence enabling his understanding of the poem.

The speaker suggests that her mother was gaining strength than she was before. In the third line of the last stanza, the writer reveals that the staccato swivel of the mother’s neck, rubbing what the night before was the wrinkled throat of an old woman. However, in the night before she had wrinkled neck, but now she was not gaining strength (Williamson, 1998). The father of the speaker was away because the mother woke up by herself and did the tasks by herself. The writer reveals that the mother was in the kitchen which was tiny and hence the occurrence of the poem in the kitchen where the father was absent.

As discussed above, it is clear that the writer uses various styles such as metaphor and alliteration which makes the poem enhance reader’s understanding as well as enhancing memorizing. These styles makes the poem more interesting to the reader and facilitates critical thinking.

My name is Fahad Alajlan, and I am from the Kingdom of Saudi Arabia. I am to the prestigious Northridge University in order to gain admission and study at the masters level. I hope to pursue a course in engineering management so that I can fulfill my career objectives. I have learnt quite a lot about this university mostly from my friends, who are alumni of Northridge University. They all have praises for the university, and how it moulds an individual to be the best that they can ever be. I want to be associated with this great university so that I can pursue my engineering education.

Spending most of my life in Saudi Arabia made me see how the country has developed in such a short time. There are many modern skyscrapers, roads, as well as other infrastructure, and I wanted to among the individuals responsible for such developments. While at Saudi Arabia, I undertook my undergraduate degree in engineering at King Saud University. I later on worked at my family’s company, and now I want to expand my career path. The United States has better universities that can provide me the educational endeavors that I seek. It is thus the reason why I choose to study at Northridge University.

My fortunate undergraduate education was marked by an exceptional grade point average. I ensured that I would maintain the best possible GPA that would ensure that I graduate with utmost honors. Since I want to join graduate school, I will ensure that I improve my performance as I will devote all my attention and thoughts into succeeding in my chosen course, which is engineering management. Early on during my studies, I found out that engineering was a subject that I would excel in since I have a natural inclination towards it. Furthermore, working in my family’s company, which deals with engineering related issues made me more informed about the career choice that I had chosen.

Northridge University comes to the very top of all my priorities since it is a known and well-established university in America, as well as the rest of the world. Concerning engineering, the university successfully provides students with research programs. Furthermore, the environment at the university is impeccable and the reason I want to pursue my engineering masters in the university. I know quite well that any individual who wants to excel as well as obtain engineering knowledge has to be in a competitive and challenging learning environment. This will stimulate an individual to realize their goals in life effectively. Sierra is a name with Spanish origin which means “saw” in English and “mountain” in Spanish. The name, however, has been used in the description of the mountain ranges because of the saw tooth appearances that exist on the picks. Sierra Nevada and Sierra Madre are good examples of the mountain ranges. It’s a name that relates to the sun rise. The beam of sun rays we see in the morning as the sun rises from the mountain peaks. Sierra for sweet and friendly, a name that matches my personality.

Sierra is a name for brown color. A color that can blend with so many other colors as one can never go wrong with brown if they use it. It is a name that my mother gave me as one of her wishes was to name a child Sierra because Sierra Boggess, celebrated American Actress was one of her favorite actresses. A name I now hold with pride as it defines who I am. The name gives me an identity that is quite unique around. In tackling moral obligation, Cicero explains how one can live and behave in the best way possible while maintaining moral obligation by doing what is honorable, doing what is expedient, as well as measures one can take when there is a conflict between being honorable and private gain.

Cicero points out honor as one of the reasons why humans make certain choices. There are certain ways that as humans we need to behave in order to coexist. In the society we live in, one is judged by their action and it is thus paramount to act in a way perceived right by the majority for example not stealing. For one to understand what is right, they need to overcome the need for excessive attachment to themselves (Cicero, pg. 87). He argues that as humans, it is our duty not to cause harm we should always strive to achieving a common good. If one is self-centered, there are least likely to have concerns over other people. Cicero goes ahead to point out how as humans, one is inclined to help even those that have done us wrong. However, those who have done wrong also need to repent for their wrong doing as a way of ensuring that they do not get to repeat the offence again. In trying to talk about how we should behave in case of war, Cicero explains that arguments can be settled either by discussion or war. We should always resort to talks in case of war and force only ought to be used when discussions cannot be held.

Cicero touches on how each individual has been bestowed by something that is different from the other person. According to him, all humans have different talents as well as natural tendencies (Cicero, pg. 107). He goes on to remark that some people may be quick, others possess strength, others imposing presence, some come off as quite attractive, others are quite brilliants while others slow, some are serious while others love gaiety. According to Cicero we are not the same and that every man needs to embrace their particular qualities although they should not retain ones that ae harmful. In embracing all our natural tendencies and the different talents that we possess then we are less likely to put ourselves in opposition to nature (Cicero, pg. 110). Through the individual nature, we gain shape to our duty.

Cicero correlates being honorable and virtue. He states that one needs to do what is honorable for example if one makes a promise, then goes back on their promise then it is most likely that the neighbor will question the character. Fellowship that one gets to maintain in the community is important and is a form of civic duty. In making this claims, Cicero contributes to Stoicism belief that an individual’s action has impact on the community they are associated with. Cicero states that each man should identify their own ability and if choices are presented to them, then one will be able to choose one that suits them best. Cicero also talks of how as humans we are in a position to freely adopt our personal decisions. Cicero talks of careers one may choose for themselves for example military affairs, philosophy or even civil law (Cicero, pg. 116). Although we have a choice, there are still chances that exist and most often we do not have control on things that happen in our lives.

In conclusion, On Duties tries to reconcile an individual’s duty to themselves, their fellow citizen, family, faith as well as homeland. His main point is as humans we need to have stability in ourselves as long as the action that one is undertaking an appropriate action. One can do expedient actions or actions that are advantageous to one’s life.

choose Uber Technologies

I choose Uber Technologies as my organization of interest for this particular project for many reasons. The first reason is the nature of the business. Although Uber came into existence in 2009 and it started as a black-car hire it has expanded widely across many continents and countries. What made the Uber industry stand out is the fact as opposed to traditional car hire services, it employs a digital approach to ensure a win-win situation for the client, the driver, and the company. In short, Uber Technologies runs all its services on an application that connects riders to clients. The most intriguing part of the business is the simplicity of the business. The Uber services took over the ridesharing services to the next level because it capitalized on convenience. Think of it this way, people are always on the move, traveling to a different destination, the store, to work, and even tending to emergencies. Uber Technologies stands out as it was the first company to develop an application that uses GPS to link a client to a driver. The fact that one can log in into an application request for a ride and have the rider pick them from their location is very attractive to my clients. Compared to the traditional method of looking for a taxi physically, most people would opt for Uber because it is convenient and secure. Additionally, I choose Uber because I was drawn to some of the advantages of using Uber. The service is very professional; you won’t find drivers communicating to you unless it is necessary. There is the option of rating drivers and reporting drivers that turn out to be unruly. Further, because the business is well-coordinated, it is easy for clients to trace previous drivers, especially in reporting a driver or tracing items that one might have forgotten.

Worth noting, some of the policies that Uber can employ in addressing sexual assault on customers are developing a sexual harassment and grievance handling policy within the organization and seeing to it that the policy is implemented. This is because having a policy without ensuring its implementation will barely bear any fruit. Over the years, Uber Technologies brand has been dragged through the mud following allegations made by clients on sexual assault, including rape by the drivers. Notably, female drivers have also found them on the receiving end from perpetrators and sexual predators posing as clients. Security issues cut across both ways hence the need to take up the matter and ensure design and implementation of grievance handling policy. I would also encourage Uber to note the changing pattern of the ridesharing business and do the needful to ensure it remains competitive. For instance, many businesses in the transport industry were gravely affected in the wake of the ongoing pandemic. This requires them to upscale their services to include food delivery, packages, and freight. Additionally, Uber Technologies should make a deliberate effort to offer attractive work schedules and competitive remunerations by reducing their commissions. When employees are happy and comfortable with their working schedules, they will remain dedicated to their work, maximizing the company’s profits.
